How does the Rule of Law work in practice in Denmark?
As a warm up to Copenhagen hosting the International Bar Association’s (IBA) Annual Conference in October, Accura, in collaboration with the Association of Danish Law Firms (Danske Advokater) and the Danish Bar and Law Society (Advokatsamfundet), invites you to a seminar focusing on the Rule of Law, and how it works in practice.

The Rule of Law under pressure in a new global reality
We are navigating a new global reality marked by geopolitical tensions and increasing regulatory complexity. This has put the Rule of Law under pressure in countries where, until recently, it was upheld as consistently as we experience in Denmark. Using two selected Danish case studies as points of departure, experts from the legislative and judicial branches, alongside representatives of the press, will engage in a timely and thought provoking discussion on how the Rule of Law operates in practice, where its boundaries lie, and what happens when those boundaries are challenged.

When the Rule of Law is challenged by the political agenda
René Offersen, attorney and partner at Offersen Christoffersen, will provide insights into the Claus Hjort Frederiksen case, which raised the fundamental question of whether a former minister can be prosecuted for disclosing confidential information that has already entered the public domain. At the same time, the case challenged core Rule of Law principles relating to open justice and the right to a full defence.

What happens when the political agenda intervenes in the legal process?
In recent years, the growing political focus on energy regulation and the green transition, including political agreements and shifting signals from Danish authorities, has created significant uncertainty around the development of energy projects in Denmark. Drawing on examples such as revised terms for offshore wind tenders, changing plans for the hydrogen connection to Germany, and new prioritisation models for access to an increasingly constrained electricity grid, where the rising power consumption of data centres is also playing an ever greater role, Clara Greve Brett, Senior Associate at Accura, will provide insights into the impact these developments have had on energy projects that constitute key elements of Denmark’s green transition.
