Edwards Lifesciences Corporation wins injunction proceedings before the Danish Maritime and Commercial High Court

Accura represented the US manufacturer of medical equipment Edwards Lifesciences Corporation in complex and substantial injunction proceedings before the Danish Maritime and Commercial High Court concerning crimpers for prosthetic transcatheter heart valves (THVs).

The products-in-suit are devices marketed and distributed by Mermaid Medical A/S, which are used to crimp (i.e. narrow) the diameter of balloon-expandable prosthetic heart valves. Crimping is done immediately before a prosthetic heart valve is implanted in human patients.

On 23 August 2023, the Danish Maritime and Commercial High Court made a ruling to grant the preliminary injunctions and order against the defendant as a result of the infringement of Edwards’s patent rights.

The court will also order Mermaid to immediately recall all deliveries of the products-in-suit in Denmark.

The products-in-suit are manufactured by Meril Life Sciences Pvt. Ltd., which is a company based in India.
